How Much Does It Cost to Hire a Real Estate Broker When Selling a Property?

Can Broker Commissions Be Negotiated?

In some cases, a tiered commission arrangement may be agreed upon. For example, a broker may receive 3% on the first ₱10,000,000 of the selling price and 1% on any amount above ₱10,000,000. The final commission structure will always depend on the agreement between the property owner and the broker.

Property owners should not be shy about discussing commission arrangements with their broker, as commission negotiations are a common practice in the real estate industry, especially for high-value properties and large transactions.

What is the Difference of Authority to Sell vs. Exclusive Authority to Sell

There are generally two ways a property owner can authorize a broker to market a property.

The first is through an Authority to Sell (ATS). Under this arrangement, the broker earns a commission only if they are the one who successfully find a buyer and completes the sale. The agreed commission and terms is negotiated and finalized in writing.

Under an Exclusive Authority to Sell, the broker is given the exclusive right to market the property for a specific period. During this period, the broker is entitled to the agreed commission if the property is sold, regardless of who ultimately found the buyer, including the property owner themselves..

An Exclusive Authority to Sell is not permanent. It is only valid for the period stated in the agreement, such as three months, six months, or one year. If the broker is unable to find a buyer within that period, the agreement simply expires and the broker no longer has any rights over the property.

However, many exclusive agreements contain a Holdover clause stating that if the property is later sold to a buyer who was introduced by the broker during the exclusivity period, the broker may still be entitled to the agreed commission even after the agreement has expired.

Because the broker has exclusive marketing rights, an Exclusive Authority to Sell often provides the following advantages to the property owner:

  • More aggressive marketing and promotion of the property
  • Greater commitment of the broker’s time and effort
  • Better coordination since there is only one point of contact for buyers and inquiries

Are There Additional Costs Aside from the Commission?

In most cases, the broker’s commission is the only compensation paid to the broker. However, there are situations where additional expenses may be charged separately. These expenses are usually for third-party services rather than the broker’s professional services.

Examples include:

  • Paid online advertising or ad boosting
  • Professional photography and drone services
  • Property staging
  • Signage and tarpaulins
  • Travel expenses for out-of-town site visits
  • Legal services provided by lawyers
  • Technical services provided by geodetic engineers, appraisers, architects, or other specialists

Any additional expenses should be clearly discussed and approved by the property owner before the service is availed.
